Word Mania Malaysia Challenge 2014

Terms of Use

Information on how to enter and prizes form part of these Terms of Use. Participation in the Word Mania Malaysia Challenge 2014' Competition which shall include the Grand Finals event ("Competition") deems that these Terms and Conditions have been accepted.

The organizer of the Competition is FrogAsia Sdn. Bhd. (hereinafter “Organizer” which shall include all its affiliates, partners, licensors, sponsors, authorized agents, licensees, representatives and assigns). The Organizer intends but does not undertake to organize the Competition.

The brief mechanism of the Competition is set out below and the Entrants (hereinafter defined) must adhere to the mechanism of the Competition as may be briefed and communicated by the Organizer from time to time during the Competition Period (hereinafter defined).

Without prejudice to the Organizer’s rights herein, the Organizer reserves the right at any time to change, amend, delete or add to the Terms of Use including to postpone, extend or re-schedule the dates of the Competition (including the Competition Registration Period), revise, change or substitute any or all of the Competition rules [(including the calculation of the Scores and the criteria for the selection of the Entrants, Finalists and Winners (hereinafter collectively defined) for any or all of the categories under the Competition], Competition prizes, alter the Word Mania Game and any associated content at its sole discretion without prior notice.

The Organizer may suspend, postpone, or cancel the Competition and/or any of the Entrants’, Finalists’ or Winners’ (for any category under the Competition) participation at any time during the Competition at its absolute discretion in which case, the Organizer may elect not to carry on with the Competition. Such suspension, postponement, or cancelation will not give rise to any claim by the Entrant and the Organizer shall not be liable for any expenditure, damage or loss incurred by the Entrant. If the Competition is resumed by the Organizer, the Entrant shall abide by the Organizer’s decision regarding resumption of the Competition and disposition of the Prizes.

A. Eligible Entrants

Entry to participate in the Competition is only open to Malaysian primary and secondary school students with a 1BestariNet Yes ID (hereinafter defined) at the time of registration ("Entrant"). An Entrant shall mean only students who have been given a valid unique user identity under the 1BestariNet program (established by the Malaysian Ministry of Education) for access to the Frog Channels (“1BestariNet Yes ID”) and who have activated their 1BestariNet Yes ID via https://www.yes.my/activation/loadMOEActivation.do and whose parent or guardian is bound (or deemed to be bound) by the Organizer’s Frog Acceptable Use Agreement. Capitalised words which are not defined herein shall have the same meaning as prescribed in the Frog Acceptable Use Agreement.

Entry in the Schools Competition category is only open to Malaysian primary and secondary government schools under the 1BestariNet program established by the Malaysian Ministry of Education ("School"). "Homeschools” and private/international schools are not eligible to participate in the School Competition.

Entrants must have parental/guardian approval to enter the Competition and the parent/guardian of the Entrant must read and consent to these Terms of Use. Parents/guardians may be required by The Organizer to enter into a further agreement as evidence of consent to the minor entering this Competition.

B. Competition Dates

1. The Competition website is open for registration from 12.01am MYT on 2 January 2014 until midnight MYT12 January 2014 (“Registration Period”). Registration Period scores cannot be used to contribute to an Entrant's scores in Round 1, Round 2 or Round 3 of the Competition. Entrants may also register following the conclusion of the Registration Period (at any time during Round 1, Round 2, or Round 3) of the Competition and may participate in the Competition from the time of registration onwards and the Entrant’s scores in Round 1, Round 2 or Round 3 of the Competition will be taken into account ONLY from the time of such registration.

2. Round 1 will be open to all eligible Entrants from 12.01am MYT on 13 January 2014 to midnight MYT 26 January 2014 ("Round 1").

3. Round 2 will be open to all eligible Entrants from 12.01am MYT on 27 January 2014 to midnight MYT 9 February 2014 ("Round 2").

4. Round 3 will be open to all eligible Entrants from 12.01am MYT on 10 February 2014 to midnight MYT 23 February 2014 ("Round 3").

5. The Competition will be held from the Registration Period until the Grand Finals event (“Competition Period”).

C. How To Enter The Competition

1. Individual Competition

The Individual Competition is a game of skill. To be eligible to win the Individual Competition, Entrants must enter the Competition by logging on to the Competition website located at www.wordmania.com.my ("Website") with their 1BestariNet Yes ID and password, then following the prompts to the Competition page during the Competition (refer “Competition Dates”). There is no fee to enter the Competition.

Entrants may access the Website and the Game through any computer at home or at the Entrant's school. The Entrant is not required to attend a physical location to enter the Competition, unless the Entrant qualifies for the Grand Finals (hereinafter defined) which will require the finalists of the Grand Finals (under the Individual Competition category) to compete at a physical location in Kuala Lumpur, Malaysia as determined by The Organizer in its sole discretion.

2. Schools Competition

The Schools Competition is a game of skill. For a School to be eligible to enter and win in the Schools Competition, it must have the criteria provided in Section D, Clause 6(b) below.

D. How To Win The Competition

The Competition is a spelling and vocabulary challenge. A software program on the Website generates a random combination of letters in a randomised format, which presents as a word puzzle known as "Word Mania". Word Mania is owned by Intrepica Pty Ltd (“Intrepica”) who is the Organizer’s partner and licensor for this Competition. Entrants are required to create as many words as they can in a three-minute time frame from the letters that are generated ("Game").

Entrants score points based on four criteria:

(a) The correct spelling of words;

(b) The length of each word;

(c) The complexity of the word; and

(d) The number of valid words created consecutively within a time period.

When an Entrant submits a word through Word Mania, the word is referenced against the "Macquarie Spellchecker Database 2012 fifth edition" ("Macquarie Dictionary") under license from Macquarie Dictionary Publishers Pty Ltd, to verify its accuracy. The Organizer has also generated a list of words that are considered profane/inappropriate. These are excluded from use in the Competition ("Profanity"). Please contact the Organizer if you wish to view the list of Profanities.

If a word is not found in the Macquarie Dictionary, or the word is a Profanity, that word is excluded from the Competition and will not count towards the Entrant's overall Score ("Excluded Word").

The software program automatically calculates the total points earned by an Entrant for all words at the conclusion of each Game to generate the Entrants' score per Game ("Score").

Individual Competition

Eligibility

(a) There will be four (4) Individual Competition subcategories comprising of:

(i) Lower Primary
(ii) Upper Primary
(iii) Lower Secondary
(iv) Upper Secondary

and there shall be three (3) individual Round top scorers (1 per Round), five (5) finalists and three (3) winners for each subcategory respectively under the Individual Competition category.

(b) Entrants are eligible to compete in all three Rounds.

Individual Round Top Scorer

(c) Entrants may play any number of games during each of the three Rounds (Round 1, Round 2, Round 3). The best ten (10) Scores out of all the Games played by an Entrant during the Round will be used to calculate the Entrant's overall individual score for the Round. The Entrant who scores the highest Score of all Entrants in the Competition for a given Round, is the Round top scorer for his/her subcategory ("Individual Round Top Scorers"). In the event of a tie, The Organizer will use the next best 10 scores from each Entrant to determine places. There are no prizes awarded to Entrants under this category of the Competition.

Finalists

(d) Five (5) finalists for each subcategory (“Finalists”) will be selected from the Competition to enter into the Grand Finals (hereinafter defined below) event. The Finalists who qualify shall be determined by the Entrants in each subcategory who generate the five (5) highest total Scores in all of the 3 Rounds [i.e. calculated by totaling their top ten (10) Games per Round (i.e. total of their Top 10 Games for Round 1 + total of their Top 10 Games for Round 2 + total of their Top 10 Games for Round 3)]. In the event of a tie, The Organizer will use the next ten (10) best Scores of such Entrants to determine places.

Individual Winners (Grand Finals)

(e) The five (5) Finalists for each subcategory will go through a series of challenges in the Grand Finals event (“Grand Finals”) to determine the champion, 1st runner up and 2nd runner up respectively for each subcategory, hereby each collectively referred to as “Individual Winners”.

(f) The Finalists for each subcategory at the Grand Finals will compete in a series of challenges for 3 rounds that will include Word Mania Game playoffs and question & answer sessions to test the speed and skills of the Finalists and each round shall be allocated a certain percentage at the Organizer’s sole discretion to total up to 100% for all 3 rounds. The Individual Winners for each subcategory at the Grand Finals shall be determined by the Finalists who generate the three (3) highest total scores accumulated in all 3 rounds of the Grand Finals (i.e. calculated by totaling their individual percentages of their total scores in rounds 1, 2 and 3). In the event of a tie, the Organizer shall add on further challenges in round 3 of the Grand Finals.

(g) The date and venue for the Grand Finals event will be announced by The Organizer to the Finalists at a later date. The Finalists must attend the Grand Finals with at least one (1) parent/legal guardian. Any Finalists, who fails to attend the Grand Finals event and/or who does not confirm participation in the Grand Finals event by the time and manner stipulated by the Organizer, shall be automatically disqualified and the Organizer reserves the rights to also automatically disqualify the Finalists if their accompanying parent/legal guardian does not attend or fails to attend the Grand Finals event with them. In the event of such a situation, the Organizer shall use the next highest scoring Entrant in that subcategory pursuant to Clause (d) above to be selected as the Finalist in that subcategory.

(h) Three (3) Individual Winners for each subcategory in the Individual Competition will be named the "Word Mania Challenge Malaysia 2014 Champion", "Word Mania Challenge Malaysia 2014 Champion 1st Runner Up", and "Word Mania Challenge Malaysia 2014 Champion 2nd Runner Up" respectively for each subcategory.

(i) Without prejudice to the Organizer’s rights herein, the Organizer reserves the right at any time to change, amend, delete or add to any or all of the rules governing the Grand Finals herein under the Terms of Use.

School Competition:

National

(a) There will be two (2) School Competition subcategories comprising of:
(i) Primary
(ii) Secondary

and there shall be three (3) School Round top scorers (1 per Round) and three (3) National School winners for each subcategory respectively under the National School Competition category.

(b) A minimum of five (5) Entrants is required to enter the Competition and play a minimum of ten (10) Games during each of the three Rounds (Round 1, Round 2, Round 3) for a School and such Entrants are eligible to compete in all three Rounds.

(c) The best fifty (50) Scores out of all the Games by all Entrants for a School will be used to calculate the School's overall score for the Round ("School Score"). An age multiplier will be applied to Scores to ensure that the School Competition is equitable. The School that scores the highest overall School Score for the Round is the Round School winner for each subcategory ("School Round Top Scorers"). There are no prizes awarded to Schools under this category of the Competition.

(d) The National School winners shall comprise of the champion, the 1st runner up and the 2nd runner up for each subcategory (“National School Winners”). The cumulative total of these top 50 Games all for 3 Rounds (i.e. total of Top 50 Games (or School Score) for Round 1 + total of Top 50 Games (or School Score) for Round 2 + total of Top 50 Games (or School Score) for Round 3) will determine the School's overall position at the end of the Competition whereby the National School Winners for each subcategory shall be determined by the Schools that generate the three (3) highest total School Scores in all of the 3 Rounds. An Entrant can contribute no more than 10 Games to their School's Top 50 Games for a given Round. In the event of a tie, The Organizer will use the next best 50 Scores from each School to determine places.

(e) The three (3) National School Winners for each for Primary and Secondary schools for the National School Competition will be named the "Word Mania Challenge Malaysia 2014 School Champion - Primary", "Word Mania Challenge Malaysia 2014 School Champion - Secondary", "Word Mania Challenge Malaysia 2014 School Champion - Primary 1st Runner Up", "Word Mania Challenge Malaysia 2014 School Champion - Secondary 1st Runner Up", "Word Mania Challenge Malaysia 2014 School Champion - Primary 2nd Runner Up", "Word Mania Challenge Malaysia 2014 School Champion - Secondary 2nd Runner Up" respectively.

Regional

(f) To be eligible to participate in the Regional School Competition category, a School would have to be qualified under the National School Competition category first.

(g) There will be five (5) regional subcategories for the Regional School Competition:

(i) Northern
(ii) Central
(iii) Southern
(iv) Eastern; and
(v) East Malaysia

and the five (5) most participative Schools for each regional subcategory (“Most Participative Regional School”) shall be recognized under the Regional School Competition category.

(h) The Most Participative Regional School shall be determined by the School that generates the highest number of Games played by all Entrants for a School for each regional subcategory respectively.

Notification

The Finalists, National School Winners (via the School’s principal) and the Most Participative Regional Schools (via the School’s principal) will be notified by The Organizer by email or via any other means chosen by the Organizer and the Individual Winners will be announced during the Grand Finals event.

The presentation of awards and prizes for all categories will be scheduled during the Grand Finals event. The prizes will be awarded to each winner’s nominated parent or legal guardian under the Individual Competition category at the Grand Finals event and if for any reason the Individual Winner’s nominated parent or legal guardian does not take or claim the prize(s) at the Grand Finals event (even with the presence of Individual Winner), then the Organizer reserves the right to forfeit the prize(s) and the Organizer, its partners, agents, sponsors and representatives shall have no liability to the Individual Winner in any respect whatsoever. Unless the Organizer prescribes other mode of collection and Winners who are unable to attend a scheduled presentation will be required to collect their prizes at the Organizer’s office at D6, 801, Jalan Sentul, 51000 Kuala Lumpur, Malaysia.


E. Prizes

Entrants and Schools have the chance to win a variety of prizes.

School Competition

The National School Winners (6 winners) will receive:

(a) Word Mania Challenge Malaysia 2014 School Champion (1st place - Primary / Secondary) – RM10,000 worth of FrogStore vouchers.

(b) Word Mania Challenge Malaysia 2014 School Champion 1st Runner-up (2nd place - Primary / Secondary) - RM5,000 worth of FrogStore vouchers.

(c) Word Mania Challenge Malaysia 2014 School Champion 2nd Runner-up (3rd place - Primary / Secondary) – RM3,000 worth of FrogStore vouchers.

as well as
A complimentary subscription of the application entitled “Literacy Planet” developed by Intrepica for access/use via the Organizer’s Frog channels or such other mediums (solely determined by the Organizer) for a period of one (1) year subject to the Organizer and Intrepica’s terms and conditions for the application. The Organizer reserves the right to determine at its sole discretion the date of provisioning/launch of the said application.

Winner certificates.

School medal or trophy.

Nationwide recognition for this achievement through announcements on any of the Organizer’s websites and / or a press release.

The Most Participative Regional School Winners (5 winners) will win RM5,000 worth of FrogStore vouchers each.


Individual Competition

Top 5 Finalists for each subcategory (20 Finalists) will each receive a goodie bag of the Organizer’s merchandise and finalists certificates.

The Individual Winners for each of the subcategory (12 winners) will receive the following:

(a) Word Mania Challenge Malaysia 2014 Champion – Samsung 4G Chromebook + RM100 Yes Credit.

(b) Word Mania Challenge Malaysia 2014 1st runner up – Yes Huddle XS + RM100 Yes Credit.

(c) Word Mania Challenge Malaysia 2014 2nd Runner Up – Yes Go Dongle + RM100 Yes Credit.


Terms and Conditions (Prizes)

The above Prizes shall be subject to the following terms and conditions:-

(a) FrogStore vouchers are non-transferable and there is no cash alternative. It can only be used to redeem the Organizer’s own products and services and its affiliates’ YTL Communications Sdn. Bhd. (“Yes”) products and services that are made available on the Organizer’s site entitled “FrogStore”;

(b) The Samsung 4G Chromebook shall be subject to the terms and conditions found at http://www.yes.my/v3/legal.do and http://www.yes.my/v3/personal/devices/samsung-4g-chromebook.do;

(c) The Yes Huddle XS shall be subject to the terms and conditions found at http://www.yes.my/v3/legal.do and http://www.yes.my/v3/support/faq/device-huddlexs.do;

(d) The Yes Go Dongle shall be subject to the terms and conditions found at http://www.yes.my/v3/legal.do and http://www.yes.my/v3/support/faq/device-go.do;

(e) The Yes Credit (Prepaid) shall be subject to the terms and conditions found at http://www.yes.my/v3/legal.do?content=CSA; and

(f) The Literacy Planet app subscription shall be subject to the terms and conditions of Intrepica’s end user license subscription which shall be provided by Intrepica at the point or commencement of such subscription.

The Website may contain links to third party sites (“Linked Sites”). Linked Sites are not under our control and we are not responsible for the content of any Linked Site or any hyperlink contained in a Linked Site (Subsequent Site). We provide these hyperlinks to you as convenience only, and the inclusion of any link does not imply any endorsement of the Linked Site by us or by our directors, officers, agents, employees and contractors. Your link to any Linked Site or Subsequent Site entirely at your own risk.

Neither we nor our directors, officers, agents, employees and contractors give any representation or warranty as to the reliability, accuracy or completeness of any Linked Sites or Subsequent Sites, nor do we or they accept any responsibility arising in any way (including negligence) for errors in, or omissions from any Linked Sites or Subsequent Sites.

When Entrants enter the Competition, Entrants agree that they are fully responsible for the Content they submit. The Organizer shall not be liable in any way for such Content to the full extent permitted by law. The Organizer may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that:

(a) They will not submit any Content that is defamatory, obscene, derogatory, unlawful or fraudulent, or that the Organizer may deem is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for minors, or otherwise unsuitable for publication;

(b) Their Content shall not contain viruses or cause injury or harm to any person or entity; and

(c) They will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the Entrant agrees to indemnify the Organizer for any breach of the above terms..


G. Personal Data Protection Policy

1. The personal information supplied by Entrants (and/or their parents/guardians/teachers) entering this Competition will be used by the Organizer in accordance with its Personal Data Protection Policy and these Terms of Use. Please refer to the Personal Data Protection Policy by visiting the Organizer’s website at http://www.frogasia.com/v3/policy/ for more information as entry in this Competition is an agreement to be bound by that policy. In addition, the Entrants consent to the Organizer and its affiliates, partners and licensors to use the Entrant's Game entries, name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Competition (including any outcome and post-Competition publicity) and promoting any products manufactured, distributed and/or supplied (including on any future marketing materials and on materials used in sending occasional news, updates and activities) by the Organizer and its partners/licensors. If at any time, the Entrant would like to unsubscribe from receiving such future emails or have their details removed from the Organizer’s database, please contact the Organizer by sending an email to bestari@yes.my. If details are removed prior to the conclusion of the Competition and/or award of prize(s), Entrants will forfeit their right to claim any prizes.

2. By entering this Competition, all Entrants hereby grant the Organizer express permission a well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share their respective entry, likeness and identity (excluding any sensitive personal information as defined by the Personal Data Protection Act 2010) for editorial, advertising, promotional, marketing or other purposes, without further compensation, for an unlimited period of time, in any of the Organizer’s publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law.


H. General

3. This is a game of skill and chance plays no part in determining the winners.

4. In the event of war, terrorism, state of emergency or disaster, The Organizer reserves the right to cancel, terminate, modify or suspend the Competition or suspend or modify a prize.

5. Incomplete entries will be deemed invalid. This includes registrations that do not contain a valid parent or guardian email address.

6. The Organizer reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence) and to disqualify any entrant who enters the Competition not in accordance with these Terms of Use or who tampers with the entry process. Failure by The Organizer to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. This Competition is completely unsupervised and relies on the Entrant's honesty in undertaking the Competition, using his or her own skill and natural ability. The Organizer has the discretion to disqualify any Entrant that The Organizer reasonably suspects in its opinion has received assistance from any person to compete in the Competition or complete any Games. The Organizer reserves the right to require an Entrant to undertake a series of Games in the presence of a The Organizer authorised representative to verify that the Entrant has participated in the Competition without assistance from any other person, before that Entrant is awarded a prize in connection with the Competition. If The Organizer determines that an Entrant has completed the Competition with assistance and disqualifies that Entrant (Disqualified Entrant), any prize that that Disqualified Entrant may have been entitled to receive will be awarded to the next eligible Entrant that would have been entitled to receive that prize, had the Disqualified Entrant not participated in the Competition.

8. Entrants are only permitted to enter the Competition using one user login. Multiple entries by creating multiple user logins will not be accepted and entrants who create more than one login for the Competition will be disqualified.

9. The prizes will be awarded to each winner's nominated parent or guardian under the Individual Competition category and to the respective School’s principal under the School Competition category.

10. The parent or guardian of each Entrant:

a. Will ensure that the Entrant in respect of whom they agree to these Terms of Use, will comply with these Terms of Use; and

b. Warrants that the Entrant in respect of whom they agree to these Terms of Use, is capable of agreeing to these Terms of Use and giving the consents contained herein.

11. The parent or guardian of each Entrant under 18 years of age agrees to indemnify The Organizer against:

a. any claims made by the Entrant, his or her guardian, any member of his or her family or any other party, against The Organizer or its affiliates in connection with the Competition or the Entrant's participation in the Competition; and

b. any losses (including any liability) caused by any act or omission of the Entrant which is inconsistent with these Terms of Use.

12. The parent or guardian of each Entrant under 18 years of age who participates in the Competition, acknowledges that they are provided with the opportunity for their child to participate in the Competition, as consideration for their agreement to these Terms of Use.

13. The Organizer may require any parental or guardian consent or agreement referred to in these Terms of Use to be produced in writing, and such consent if requested must include the words "in consideration for FrogAsia Sdn. Bhd. agreeing to admit the Entrant into this Competition, [name of Parent or Guardian] agrees to be bound by the terms of entry into the Competition."

14. If there is a dispute as to the identity of an Entrant, The Organizer reserves the right, in its sole discretion, to determine the identity of the Entrant.

15. The Organizer's decision is final and no correspondence will be entered into. Subject to the Organizer’s rights to replace a winner as provided herein, results once announced are deemed to be final and binding.

16. If for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by The Organizer, then the prize (or that element of the prize) will be forfeited by the Organizer and the Organizer, its partners, agents, sponsors and representatives shall have no liability to the winners in any respect whatsoever.

17. The Organizer does not guarantee the availability of any of the prizes and if any prize (or part of any prize) is unavailable, The Organizer, in its discretion, reserves the right to replace and/or substitute the prize (or that part of the prize) with any other prize to the equal value and/or specification as determined by the Organizer its agent or sponsors at its sole discretion.

18. Prizes, or any unused portion of a prize, are not transferable redeemable assignable or exchangeable and cannot be taken as cash, unless otherwise specified. All specific or special terms and conditions that are attached to the Prize (whether by the Organizer, its partners/licensors or sponsors) must be adhered to by the winners (and their respective parents/guardians).

19. The Entrants agree that if the Competition involves a School winning and his/her School emerges as a winner under the School Competition category,

(a) the Organizer is authorized to award the prize(s) to the School’s principal and the School principal shall have the sole discretion as to the manner and means to distribute such prize(s) awarded for their respective School;

(b) In such event, the Entrant shall liaise directly with his/her School principal arising out of or in connection with the prize(s) (if any) and shall not have any claims whatsoever against the Organizer for the prize(s) or any part thereof.

20. Entrants are responsible for any and all taxes payable as a result of the prize(s) being awarded or received (if applicable).

21. All prize(s) are given and accepted on an ‘as is’ basis and entirely at the risk of the Entrants and are awarded by the Organizer and/or its partners or sponsors without any warranty of any kind express or implied, as to the condition or state of the prizes. Acceptance of the prize shall constitute a release and discharge of the Organizer by the winner from any and all liability, claims, demands, causes of action, and/or damages, whether known or unknown, which the winner may have, of any nature whatsoever, arising out of or relating to the Competition and/or personal injury and/or property damage, theft or loss suffered by the winner as a result of the use and/or enjoyment of the prize. The Entrant shall execute a deed of release and indemnity in a form prescribed by the Organizer, if so required, in order to receive the prize.

22. If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Organizer, including but not limited to technical difficulties, unauthorised intervention or fraud, The Organizer reserves the right, in its sole discretion (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate and shall be liable to compensate the Entrant in any manner whatsoever in such circumstances.

23. Any cost associated with accessing the Website is the Entrant's responsibility and is dependent on the internet service provider used.

24. The Organizer (including its respective directors, officers, employees, agents and assigns) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out or in connection with the Competition, the participation by the Entrant in the Competition and/or the Prizes awarded.

25. The Organizer (including its respective officers, employees and agents), and its affiliates are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under The Organizer's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, misused, damaged or misdirected (whether or not after their receipt by the Organizer); (d) any variation in prize value to that stated in these Terms of Use; (e) any tax liability incurred by a winner or entrant; (f) use/access/taking of a prize awarded under the Competition including by the School’s principal under the School Competition category; or (g) any failure to win a prize in the Competition.

26. The Entrant shall indemnify the Organizer, its affiliates, partners, licensors, agent and sponsors from and against all liability, cost, loss or expenses suffered whatsoever arising as a result of the Entrant’s/Winner’s breach of the Terms of Use and/or rules of the Competition in accordance with Clause 11 above (Section H).

27. The Entrant shall not be entitled to assign any of the rights or sub-contract any of the obligations herein. The Organizer shall be entitled to assign or sub-license the whole or any part of its rights hereunder to any third party as may be determined by the Organizer.

28. All rights and privileges herein granted to the Organizer are irrevocable and not subjected to rescission, restraint or injunction under any and all circumstances. Under no circumstances shall the Contestant have the right to injunctive relief or restrain or otherwise interfere with the organization of the Competition, the production, distribution, exhibition and/or exploitation of the Competition and/or any product based on and/or derived from the Competition.

29. The invalidity, illegality or unenforceability of any terms hereunder shall not affect or impair the continuation in force of the remainder of the Terms of Use of the Competition.

30. The Organizer collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to its partners, licensors, agents, contractors and service providers. If the personal information requested is not provided, the Entrant cannot participate in the Competition. By participating in the Competition, each Entrant consents to The Organizer using and disclosing their personal information to The Organizer's related entities, agencies and other third parties engaged to provide services in connection with the Competition, for use for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to The Organizer. Entrants provide this consent until such a time as they withdraw it by giving notice to The Organizer.

31. The main language of the Terms of Use shall be the English language. Any translation to any other language than English shall be for convenience only. In the event of any inconsistency between this English language and any other language, the English language version shall prevail and govern in all respects.

32. The Terms shall be construed, governed and interpreted in accordance with the laws of Malaysia and by entering the Competition, the Entrant submits to the exclusive jurisdiction of the courts of Malaysia.
